This document has the role of informing you about what kind of personal data we collect from you, how and where we can use this data, how we understand how to protect this data, who has access to it and how it can be corrected in time the inaccuracies in the information taken over.

SOFTWIN SRL as site administrator respects the privacy and security of information provided by users, including personal data.

SOFTWIN SRL is a personal data operator within the meaning of EU Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 (EC) , has its registered office in Str. We comply with the Romanian and European legislation in force in the field of personal data protection and collect personal data only for specified purposes.

The purpose of collecting personal data is to sell products and services on the Site (with all related activities such as order processing, delivery, payment, billing, etc.), customer service and marketing activities for our own needs.

Your personal data are solely used by us for the above purposes and cannot be sold or leased to third parties.

The legal grounds for processing these data are:

contract execution and preliminary steps for this contract (Article 6 (1) b GDPR) - for data collected through the order form or data received as a result of customer service;
legal obligations (Article 6 (1) c GDPR) for billing data required;
the legitimate interest (art 6 (1) f GDPR and law 506/2004 art 12 (2)) for the data used for marketing for current customers, the security of the Site and the data used to optimize the Site;
consent (GDPR art 6 (1)) for marketing data for site visitors (e.g., subscription to newsletters, marketing cookies, etc.).

2. What personal data do we collect and who has access to your data?

SOFTWIN collects information from its users in three ways: directly from the user, from the traffic reports registered by the servers hosting our sites and through cookies.

2.1. Personal data collected directly.

When you access our Website or when you create an account or place an order, we may ask for your name, surname and / or email address, telephone number, delivery address, personal numeric code, and other data required for contracting, delivering or invoicing or resolving your requests, questions, or complaints made by you, recording your information for the allocation or reward, rebates, and other benefits, as well as meeting other requests or requirements that you have about with customer reward programs and other similar programs. These data are kept for a period of 3 years from the termination of the contract (this is the general limitation period) or 10 years for invoices (where there is a legal tax obligation). If you do not give us this data, we will be unable to honor your order.
Also, when you access our support services by phone, chat, or another way, we may ask you for an email address or phone number. We reserve the right to record any communication made thru our service support channel to improve our services. We will inform you before the communication begins that it may be registered. These data are retained for different periods of time but no more than 3 years after the last communication with you. This period is necessary to be able to defend us against any complaints that may arise regarding the issues you have identified or third parties. These data are used, for example, for the purpose of contacting you, establishing the necessary data for the contract or billing, or the contact person and / or to resolve your complaint / request. We may also request other data that may constitute data with personal data only to the extent that they are necessary for these purposes.
Also, when subscribing to our newsletters, please give us an email address, a name, and other information necessary to customize the communication to you. These data are kept until the consent is revoked, or until the activity it shows that you are no longer interested in our communication.
When making a payment. All payments are processed by Avangate BV | De Cuserstraat 93, 2nd floor, 207-208 office, 1081 CN, Amsterdam, Netherlands, so bank information is sent to them. Personal data processing policies are available on the Partner's own website.

2.2. Information provided automatically from the server traffic report.

When visiting a Web Site, regardless of the device used, disclose certain information about you, such as your IP address, the time of your visit, where you entered our websites, the visited pages, the type of device, operating system. SOFTWIN, like other operators, records this information for a certain amount of time. SOFTWIN uses external traffic analysis services such as Google Analytics, HotJar, Google TagManager, Google Search Console.

These data are used exclusively by us to improve our Site and services, and to ensure the security of our Site.

Under no circumstances SOFTWIN uses traffic data to identify people behind IP addresses.

This data is retained for the purpose of improving the Site or for statistical purposes, but also for improving our Web services and ensuring their security. Most of these data are only used as aggregate data. The data is kept only for as long as necessary for these purposes. The legal basis for this collection is a legitimate interest in improving and ensuring the security of our Website.

2.3. Cookies

SOFTWIN can use cookies to help storage and track your preferences, but also to optimize the Website, including personalization, or marketing.

As for external services to the site that places third-party cookies when they browse the website, their purpose is for marketing, traffic analysis, or other customizations, as detailed below:

These data are retained for a different time depending on the external service provider but which will not be longer than 50 months.

3. Hosting the data

Information, including personal data, received on our servers will be recorded, used, stored and organized on protected servers, where the Website itself is hosted, as well as on any other media that permits such operations in secure optimal, by appropriate means. If we do not use our own servers, for the safe hosting of personal data, we use the services of specialized companies from the European Union, acting as persons authorized by us. You can find more details in section 7.

4. How do we protect the information you collect.

The privacy and protection of the information you collect are of particular importance to us.

Your access to our services and products is protected by your account password. We recommend that you do not disclose this password to anyone. We will never ask for your account password in unsolicited messages or phones. Furthermore, if possible, you must remember to sign "log off" / "sign out" from your online service account at the end of each session. We also advise you to close the browser window you worked at the end of your navigation in Website or Services provided by the Website. These tips are designed to prevent unauthorized people from accessing personal information about you when other people can access your device.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% safe. According to GDPR, you have the right to access, correct or delete them or restrict the processing or the right to oppose the processing, as well as the right to the portability of personal data interference data.

You also have the right to lodge a complaint with a supervisor or file an action in court.

7. Who has access to your information

SOFTWIN can use other IT companies to process the collected personal data. These companies are considered empowered and have strict contractual obligations to maintain the confidentiality of the processed data and to provide at least the same level of security as SOFTWIN. Empowered persons are required not to allow third parties to process personal data on behalf of SOFTWIN and to access, use and / or retain confidential data.

SOFTWIN may host personal data in Romania as well as in the European Union or any other jurisdiction that offers an adequate level of protection of personal data in accordance with European Union standards, including US-EU Shield Privacy programs.

Due to confidentiality and security requirements, specific information about the names and details of each authorized person will be provided only to the competent authorities.

Employed Persons empowered to process personal data for:

Payment processing services in the EU;
Delivery services in Romania;
Data hosting services in Romania;
Customer assistance services in Romania;
Marketing services (including e-mail marketing) in Romania and the USA

All US persons empowered by us to process personal data are certified in the US-EU Shield Privacy program.

In case of special situations. SOFTWIN may disclose personal data when the law expressly so provides, when requested by a competent authority or when it is necessary to protect our legitimate rights and interests.

The website does not collect or process any special information, so please do not disclose any information, personal data of yourself or of any third party regarding racial or ethnic origin, political opinions, religious confession or philosophical beliefs, or membership of trade unions genetic data, biometric data, health data, or data about sexual life or sexual orientation in communications made to us.

This policy on personal data processing was adopted today, 18 May 2018, and in the future, whenever we modify it, we will publish the new version on the first page of the Websites and send information to that effect.
